All the Regional Joint Directors of School Education and the District Educational Officers in the State are informed that certain lapses are identified in the field level with regard to the permission and Recognition issued to the Private Unaided Schools without following the Provisions laid down in G.O.Ms.No.1, Education (P.S.2), Dated:01.01.1994 and its amendments.

 

In this regard, it is informed that the following defects are noticed:


  1. There are no rules and Provisions for issuance of Provisional Recognition in respect of Private Unaided Schools. But the District Educational Officers and Regional Joint Directors of School Education have accorded provisional Recognition which is against the rules. That is being misused by the Private managements with tacit understanding with the Regional Joint Directors of School Education and District Educational Officers.
  1. No private Unaided school should function without recognition from the Competent authorities concerned as per the rules provisioned in O.Ms.No.1, Education (P.S.2), Dated:01.01.1994 and its amendments. Where as it is noticed that some of the private Unaided schools are functioned without permission / recognition which the against the rules.
  1. Some of the Private Unaided Schools in the State are running having opening permission only and not getting the recognition from the competent authorities and conducted the classes which is against the rules and they should obtain the Recognition from the competent authority. The Validity of the permission as per under sub rule (1) of rule 8 of G.O.Ms.No.1, Education (P.S.2), Dated: 01.01.1994 as follows:

Permission granted or deemed to have been granted under rule 7 by the competent authority is valid only up to the end of July of every year. It shall be incumbent upon the educational agency to apply, in the manner prescribed under these rules for recognition. Failure to do so will result in the permission being automatically lapsed. The burden of proof of having applied for recognition shall lie with the educational agency”.

  1. The UDISE Codes are not being given to the Schools, having opening permission but not having recognition. Due to this, though there is an enrollment, but not reflecting in Child info which impacts in losing the benefit's provisioned by the Government to the students.
  1. The RJDsSE are submitting the proposals for opening permission/ up gradation of unaided schools for the Academic year 2022-2023, even after 3 months from the commencement of the academic year.

In this connection, the School Management should obtain the recognition in time before the expiry of validity and should be inspected by the Competent authorities concerned as per Rule 3 of (1) and (2) in G.O.Ms.No.1, Education (P.S.2), Dated:01.01.1994.


Further, certain instructions were issued by this office to all the Regional Joint Directors of School Education and District Educational Officers in the State in the reference 3rd read above, as follows:

The RTE Act, 2009 covers only classes I to VIII only. As per Rule 29 of GO.Ms.No.20 School Education(PE-PROG.1) Department dated: 03.03.2011, the existing Acts, rules, regulations, Executive instructions issued by the Govt of AP, the C&DSE inconsistent with these rules shall be deemed to be void to the extent of inconsistency. Hence, with regard to Pre-primary and classes IX and X the provisions of G.O.Ms.No.1, Edn (PS.2) dept., dt:01.01.1994 shall be followed and pertaining to the School recognition, provisional certification, withdrawal of recognition etc., shall be followed as specified in GO.Ms.No.20 School Education (PE-PROG.1) Department dated: 03.03.2011., viz Renewal of recognition shall be for a period of three years”.

In view of the above, all the Regional Joint Director of School Education and District Educational Officers in the State are instructed to review the provisional Recognition orders issued by them in their jurisdiction with in 15 days and cancel the orders which were issued against the rules. Further they are requested to take necessary action against the managements which were not obtained the recognition from the competent authority concerned and conducting the classes against the rules. And also requested to submit compliance report immediately.

 

Further they are informed to follow the Act, rules and instructions scrupulously without any deviation. If any deviations found later in this regard stringent disciplinary action will be initiated against the concerned.
