ORDER:
The Chapter XI of the Andhra Pradesh Education Act, 1982 provides for takeover of management of educational institutions in public interest. Vide G.O second read above, the Government has formulated a policy for takeover of willing Private Aided Degree Colleges in the State EITHER with assets which will make the institutions as Government Educational Institutions without any liabilities and financial burden on the State exchequer OR without assets by surrendering the aid in the form of surrendering all the duly sanctioned aided posts along with aided staff which will make the institutions as Private Unaided Educational Institutions.
As such, earlier vide the G.O first read above, the Government has issued special rules named ‘Andhra Pradesh Taken Over Colleges (Collegiate Education and Intermediate Education) Service Rules’ for the teaching and non-teaching staff of Private Degree and Junior Colleges taken over by the Government on or after 18th July 1982 who opt to be governed by those Rules. However, there are no Special Rules for the staff where the managements are willing to surrender, their duly sanctioned aided posts and the aided staff (both teaching and non-teaching) to the Government.
Sub-section (b) of section 73 of the Andhra Pradesh Education Act, 1982 provides that a person, the staff of taken over educational institutions, whose services have been retained by the Government shall be governed at his option either by the conditions of service as may from time to time as prescribed by the Government or by the conditions of service applicable to him immediately before vesting of the institution in the Government.
Further, the Rule 35(b) of Andhra Pradesh State and Subordinate Service Rules, 1996 reads as “the seniority of a member of a service, class or category, who is transferred on his own request from one unit of appointment to another unit of appointment shall be fixed with reference to the date of his joining duty in the latter unit of appointment.”
Furthermore, as per the information received from the Commissioner of Collegiate Education, Andhra Pradesh as on 31.08.2021, more than 90% of the Private Aided Degree Colleges have submitted their willingness to surrender all of their duly sanctioned aided posts along with the aided staff (both teaching & non-teaching) and their Aided Staff have also submitted willingness for absorption into Government as per the said Thus, Special Service Rules shall be issued for them and the Rules so issued separately shall be binding on such aided staff who are willing to be absorbed into Government as the absorption is based on their willingness to do so;
Additionally, Para 5(1) of the Andhra Pradesh Public Employment (Organization of Local Cadres and Regulation of Direct Recruitment) Order, 2025 provides that each part of the State, for which a local cadre has been organized in respect of any category of posts, shall be a separate unit for the purpose of recruitment, appointment, discharge, seniority, promotion and transfer and such other matters as may be specified by the State Government in respect of that category of posts. Furthermore, Para 5(2)(a) of the said order provides that nothing in the order shall prevent the State Government from making a provision for appointment by transfer of a person from any local cadre to any office or Establishment to which this order does not apply where such provision is specified in the rules of the department concerned.
The Government, after careful examination of the matter (and with the concurrence of the Andhra Pradesh Public Service Commission vide Letter third read above), decided to make a provision for transfer of taken over staff of the erstwhile Private Degree Colleges to the respective equivalent local cadres in the Government Colleges in respect of those persons who have submitted their willingness to be absorbed into Government and so opted to be governed by the conditions of service prescribed by the Government. It is further decided that in their cases for appointment as full members of service and seniority, the service shall be reckoned from the date of such appointment by transfer on takeover of the staff. However, the seniority of the staff who are already working in the equivalent class and category of posts in the Government Colleges in the respective local cadre shall not be disturbed.
Accordingly, the following notification will be published in the extra- ordinary issue of Andhra Pradesh Gazette on 12.06.2026: -
NOTIFICATION
In exercise of the powers conferred by sub-clause (xxxiv) of clause (b) of sub-section (1) and sub-section (2) of section 99 read with section 73 of the Andhra Pradesh Education Act 1982, the Government hereby makes the following Special Rules to regulate the conditions of service of the staff (both teaching and non-teaching) who are taken over by the Government from Private Aided Degree Colleges for absorption into Government: -
RULES
Short title, applicability and commencement: -
- These rules may be called the Andhra Pradesh Taken Over Staff (Higher Education) Service Rules, 2026.
- These rules shall be applicable to all the teaching and non-teaching aided staff taken over by the Government from Private Aided Degree Colleges on or after 10th August, 2021 for absorption into Government as per the policy issued vide O.Ms.No.42, Higher Education (CE) Department, Dated:10.08.2021.
- These rules shall be binding on all of the taken over staff as the absorption is based on their willingness to do so.
- These rules shall be deemed to have come into force on 10th August, 2021.
- shall be deemed to have been appointed by transfer to the equivalent class and category of posts;
- shall be appointed against either regular vacancies available in Government Degree Colleges or Supernumerary posts created only to the extent of required number after exhausting the regular vacancies available in the respective local cadre for each category of posts:
- Provided that all the supernumerary posts so created shall be on temporary arrangement basis in order to draw their pay and allowances and all such posts shall stand abolished as and when respective staff member in such post exits from service in the post due to promotion / retirement / resignation / demise or any other reason;
- shall be governed by all the respective service rules such as deputation on foreign service policy, transfers policy, CCA Rules , as amended from time to time, applicable to the Staff of Government Degree Colleges already working in the equivalent class and category of posts;
Provided that the updated terms and conditions under Foreign service terms and conditions, from time to time also be applied with regard to the Deputation policy and payment of salaries there on.
- shall have their seniority reckoned in the relevant cadre from the date of joining in such appointment by transfer into Government:
Provided that the seniority of the staff who are already working in the equivalent class and category of posts in the Government Colleges in the respective local cadre shall not be disturbed;
- shall be adjusted to any new Government Degree College established but pending sanction of posts by the Government or any needy Government Degree College in any other zone/district in the case of surplus staff in a zone/district OR may be sent on deputation basis to a State Government Institution / a State funded Institution including State Universities with necessary approval of the governing body of the institution keeping in view of the workload and staff requirement; however, they have to be considered for posting back to their local Zones/Districts as per localization of cadres (Presidential Order, 2025) issued in O.Ms.No.45 GAD (SPF&MC) Department, dated:20.04.2026, subject to availability of vacancies in that particular local cadre:
Provided that the pay and allowances of the staff so adjusted on deputation basis in other zones/districts or other institutions/universities shall be drawn by the respective Principal of Identified Government Degree College in the zone/district to which the staff is local:
Provided further that notwithstanding any ban being imposed on transfers, as and when a corresponding vacancy arises in the local cadre and on the request of the concerned staff, the staff so adjusted outside their local cadre shall be repatriated to their local cadre through a transparent process.
