ORDER:
In the G.O. 1st read above, the Government has framed the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010, under the provisions of the Right of Children to Free and Compulsory Education Act, 2009 (Act No.35 of 2009) and published the Notification in Extra-ordinary issue of the Andhra Pradesh Gazette, dated:05.03.2011.
- In the G.Os 2nd to 9th read above, the Government has subsequently amended the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010.
- In the G.O.10th read above, Government has accord permission for restructuring the existing non-residential schools run by State Government, Mandal Parishad, Zilla Parishad, Municipal and Tribal Welfare Departments schools into (i) Satellite Foundational School (PP1 & PP2);
(ii) Foundational School (PP1, PP2, Class 1 &2); (iii) Basic Primary School (PP1, PP2, Class 1 to 5); (iv) Model Primary School (PP1, PP2, Class 1 to 5); (v) Upper Primary School (PP1, PP2, Class 1 to 8) vi) High School (Classes 6 to 10) vii) High School (Classes 1 to 10) viii) High School Plus(Classes 6 to 12) ix) High School Plus (Classes 1 to 12) with an objective of improving learning outcomes of children studying in Government schools.
- Therefore, Government has decided to amend the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010.
- Accordingly, the following notification will be published in an Extra- Ordinary issue of the Andhra Pradesh Gazette dated.13.05.2025.
NOTIFICATION
In exercise of the powers conferred by sub-section (1) of section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (Act No.35 of 2009), the Government of Andhra Pradesh hereby makes the following amendments to the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010 issued in G.O.Ms.No.20, School Education (PE-Progs.I) Department, Dated.03.03.2011, as subsequently amended from time to time.
AMENDMENTS
In the said Rules:
- In rule 3, in sub-rule (1),-
- For clause (12), the following shall be substituted, namely:
“(12) ‘Elementary School’ means a school that imparts education between classes I and class VIII. It includes all existing schools in Andhra Pradesh, namely, Foundational, Basic Primary School, Model Primary School, Upper Primary Schools and High Schools having these classes.”
- For clause (18), the following shall be substituted, namely:
“(18) ‘Neighbourhood area of a school’ means the habitations in a safe walking distance of 1 km for a Foundational/ Basic Primary School/ Model Primary School, 3 kms for a Upper Primary School / High School having classes VI to VIII.”
- For clause (20), the following shall be substituted, namely:
“(20) (c) ‘Basic Primary School/ Model Primary School’ means a school that imparts education for PP1, PP2, Classes I to V.
(d) ‘Upper Primary School’ means a school that imparts education for Classes I to VIII.”
- In rule 5,-
- In sub-rule (1), for clause (c), the following shall be substituted, namely:-
“(c). Transport allowance shall be provided to the children within the age group of 6 to 14 years where there is no availability of Foundational/Basic Primary/ Model Primary School (I to II/V classes) within a radius of 1(one) kilometre.”
- In sub-rule (1), for clause (d), the following shall be substituted, namely:
“(d). Transport allowance shall be provided to the children where there is no availability of Upper Primary School/ High School (VI to VIII classes) within a radius of 3 (three) kilometers.”
- For sub-rule (2), the following shall be substituted, namely:
“(2) Wherever required, the State Government shall upgrade existing Basic Primary School/ Model Primary schools with classes PP1 to Class 5 by adding classes VI-VIII and in case of existing Upper Primary School having classes I-VII by adding class VIII.”
- In rule 7, in sub-rule (4), for clause (c), the following shall be substituted, namely:
“(c) Satellite Foundational/ Basic Primary School/ Model Primary School that the child has attended (up to age six) or attending.”
- In rule 19, in sub-rule (1),
- (i) For clause (b), the following shall be substituted, namely:
“(b) The school having both Foundational/ Basic Primary School/Model Primary School and Upper Primary School shall have one School Management Committee for the entire school.”
- For clause (c), the following shall be substituted, namely:
“(c) In case of schools having classes from PP1 to 10 for both Foundational/ Basic Primary School/ Model Primary School/ Upper Primary School and High Schools there shall be one School Management Committee for the entire school.”
- For clause (d), the following shall be substituted, namely:
“(d) The School Management Committee once constituted shall exist perpetually until its abolition or merger, to be authorized by the Mandal Education Officer in case of Foundational/ Basic Primary School/Model Primary School / Upper Primary School and the District Education Officer in case of other schools. However, members will retire as per their terms. The resultant cyclical and casual vacancies shall be filled within reasonable time as prescribed by the Implementation Authority.
- In Appendix, in Form I, -
- for table (G)(1), the following shall be substituted, namely:
“(G)(1) Teachers in Foundational/ Basic Primary School/ Model Primary School.”
- for table (G)(2), the following shall be substituted, namely: “(G)(2) Teachers in Upper Primary School.”
- The Director of School Education, the State Project Director, AP Samagra Shiksha and the Director, State Council of Education Research & Training (SCERT) shall take further necessary action, accordingly in the in the matter.
